Welcome to Pontools.net, an online service providing software and tools to enhance the functionality and experience of Proton products. Pontools.net is independently owned and operated and is not affiliated with or endorsed by Proton. ("Pontools.net" "we," or "us"). This page explains the terms by which you may use our services (the "Services"). By accessing or using the Pontools.net services, website, applications and software provided through or in connection with the service, including through a mobile device, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement ("Agreement"), whether or not you are a registered user of our Service.

We reserve the right to amend this Agreement at any time and without notice. If we do this, we will post the amended Agreement on this page and indicate at the top of the page the date the Agreement was last revised. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Use.

Use of Our Service

Pontools.net provides software and tools to enhance the functionality and experience of Proton products.

Pontools.net grants you permission to use the Service as set forth in this Agreement, provided that: (i) you will not copy, distribute, or disclose any part of the Service in any medium; (ii) you will not alter or modify any part of the Service other than as may be reasonably necessary to use the Service for its intended purpose; and (iii) you will otherwise comply with the terms and conditions of this Agreement.

Your Data & Your Privacy

By using our Services you may give us access to your information, project data, files, and folders (together, "your data"). You retain ownership to your data. You are also solely responsible for your conduct, the content of your files and folders, and your communications with others while using the Services. We will never use any data we have access to for anything that is not absolutely necessary to provide the Service.

Your Responsibilities

Files and other content in the Services may be protected by intellectual property rights of others. Please do not copy, upload, download, or share files unless you have the right to do so. You, not Pontools.net, will be fully responsible and liable for what you copy, share, upload, download or otherwise use while using the Services.

Account Security

You are responsible for safeguarding the password that you use to access the Services and you agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized that activity.

User Content

Some areas of the Service may allow Users to post feedback, comments, questions, data, and other information ("User Content"). You are solely responsible for your User Content that you upload, publish, display, link to or otherwise make available (hereinafter, "post") on the Service.

Our Proprietary Rights

Except for your User Content, the Service and its materials, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos and music (the "Pontools.net Content"), and all Intellectual Property Rights related thereto, are the exclusive property of Pontools.net and its licensors.

Fees & Payment

Fees: Customer will pay, and authorizes Pontools.net to charge using Customer's selected payment method, for all applicable fees. If Customer enrolls in the annual billing plan, fees are refundable within the first 30 days of the Services. Otherwise, fees are non-refundable except as required by law.

Code of Conduct

Pontools.net has the right, but not the obligation, to remove Content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable.

Pontools.net is Available "AS-IS"

THE SERVICES AND SOFTWARE ARE PROVIDED "AS IS", AT YOUR OWN RISK, WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL Pontools.net, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES.

Miscellaneous Legal Terms

These Terms constitute the entire and exclusive agreement between you and Pontools.net with respect to the Services, and supersede and replace any other agreements, terms and conditions applicable to the Services.
